Welcome to Pixium. These Terms of Service ("Terms") govern your use of our website and the digital services we provide. By accessing our website or engaging our services, you agree to be bound by these Terms. Please read them carefully.
Pixium provides professional web design, web development, hosting, maintenance, and related digital services ("Services") to clients on a project-by-project basis. Each client engagement is governed by a separate written contract or agreement that outlines the specific scope, deliverables, timeline, and pricing for that project.
By using our website, submitting an inquiry, or entering into a service agreement with us, you acknowledge that you have read, understood, and agree to be bound by these Terms, as well as our Privacy Policy. If you do not agree to these Terms, please do not use our website or services.
All Services are provided under individual contracts or service agreements between Pixium and the client. These agreements will specify:
In the event of any conflict between these Terms and a signed service agreement, the terms of the service agreement shall prevail.
For lump sum pricing, clients are required to pay 50% of the total project cost upfront before work begins. The remaining 50% is due upon project completion and before the final website is delivered or made live. Monthly hosting fees are billed separately on a recurring basis.
For monthly subscription plans, clients are billed on a recurring monthly basis. Services will continue until either party provides written notice of cancellation in accordance with the service agreement. Payment is due at the beginning of each billing cycle.
E-commerce projects typically follow a milestone-based payment structure as outlined in the service agreement. Payment terms will be clearly specified in your contract.
Late payments may result in suspension of services or late fees as specified in your service agreement. We reserve the right to suspend or terminate services for non-payment.

Clients retain all rights to content, images, logos, and materials they provide. By providing these materials, clients grant us a license to use them for the purpose of delivering the contracted services.
For lump sum projects, upon receipt of full payment, clients receive ownership of the final custom design and website code specific to their project. However, we retain the right to reuse general techniques, methodologies, and non-custom components.
For monthly subscription plans, Pixium retains ownership of the website design and code. Clients are granted a license to use the website for the duration of the subscription. Upon cancellation, the client retains ownership of their content and domain but not the website code or design.
We reserve the right to showcase completed projects in our portfolio and marketing materials unless otherwise agreed upon in writing.
We strive to deliver high-quality services and ensure that all websites function as intended. However:
To the fullest extent permitted by law, Pixium shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from or related to the use of our services or website. Our total liability for any claim shall not exceed the amount paid by the client for the specific services giving rise to the claim.
Clients agree to indemnify and hold harmless Pixium from any claims, damages, or expenses arising from:
The initial 50% deposit is non-refundable once work has commenced. If the client cancels before project completion, they will be charged for work completed to date. The final 50% payment is required before delivery of the completed website.
Either party may cancel the monthly subscription with 30 days' written notice. No refunds will be provided for partial months. Upon cancellation, the client's website will be taken offline unless alternative arrangements are made.
We respect the confidentiality of client information and will not disclose proprietary or sensitive information to third parties, except as required by law or with client consent. Clients agree to keep any proprietary information about our business processes confidential.
Any disputes arising from these Terms or our services shall be resolved through good-faith negotiation. If a resolution cannot be reached, disputes shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, conducted in Atlanta, Georgia.
These Terms shall be governed by and construed in accordance with the laws of the State of Georgia, without regard to its conflict of law principles.
We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting to our website. Continued use of our services after changes are posted constitutes acceptance of the modified Terms. Existing service agreements will remain governed by the Terms in effect at the time of signing.
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
These Terms, together with any signed service agreement and our Privacy Policy, constitute the entire agreement between you and Pixium regarding the use of our services.
